1. Agreement to Terms

By accessing or using the GlobalPartsHub platform ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service. These Terms apply to all users, including buyers, suppliers, and visitors.

2. Description of Service

GlobalPartsHub is an AI-powered aviation marketplace platform that connects buyers and suppliers of aircraft parts. The Service provides features including:

  • Advanced search functionality (Part Number, ATA, NSN, Aircraft Type)
  • Supplier storefronts and inventory management
  • AI-powered Request for Quotation (RFQ) system
  • Transaction facilitation between buyers and suppliers
  • Communication and messaging tools

3. User Accounts

3.1 Registration

To access certain features, you must register for an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate and current.

3.2 Account Security

You are responsible for safeguarding your account credentials and for all activities that occur under your account. You must immediately notify us of any unauthorized use of your account.

3.3 Account Types

  • Buyer Accounts: For airlines, MROs, and aircraft operators
  • Supplier Accounts: For parts distributors and manufacturers
  • Hybrid Accounts: For entities operating as both buyers and suppliers

4. User Obligations

You agree to:

  • Provide accurate information about parts, services, and business operations
  • Comply with all applicable aviation regulations and standards
  • Maintain proper certifications and documentation for all parts
  • Conduct transactions in good faith and honor commitments
  • Respect intellectual property rights of others
  • Not engage in fraudulent, misleading, or illegal activities
  • Not interfere with or disrupt the Service or servers

5. Transactions and Payments

5.1 Marketplace Role

GlobalPartsHub acts as a marketplace platform connecting buyers and suppliers. We are not a party to the actual transactions between users. All transactions are directly between buyers and suppliers.

5.2 Pricing and Fees

Suppliers set their own prices. Platform fees and subscription costs will be communicated clearly before any charges are incurred. All fees are non-refundable unless otherwise stated.

5.3 Payment Processing

Payment processing may be handled by third-party payment processors. You agree to comply with their terms and conditions.

6. Intellectual Property

6.1 Platform Ownership

The Service and its original content, features, and functionality are owned by GlobalPartsHub Technology Sdn Bhd and are protected by international copyright, trademark, and other intellectual property laws.

6.2 User Content

You retain ownership of content you submit to the Service. By submitting content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, and display such content in connection with the Service.

7. Compliance and Certifications

Users must ensure compliance with:

  • Aviation safety regulations (FAA, EASA, ICAO, etc.)
  • Export control laws and international trade regulations
  • Anti-money laundering (AML) and counter-terrorism financing requirements
  • Industry-specific quality standards (AS9120, ISO certifications)
  • Authenticity and traceability requirements for aircraft parts

8. Prohibited Activities

You may not:

  • List or sell counterfeit, unapproved, or non-compliant parts
  • Misrepresent part conditions, certifications, or specifications
  • Engage in price manipulation or market abuse
  • Use automated systems to scrape or collect data without permission
  • Circumvent platform fees or transaction processes
  • Violate any applicable laws or regulations

9. Disclaimers and Limitations

9.1 Service "As Is"

The Service is provided "as is" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

9.2 Third-Party Content

We do not guarantee the accuracy, quality, or authenticity of parts listed by suppliers. Buyers are responsible for verifying all information and conducting appropriate due diligence.

9.3 Limitation of Liability

To the maximum extent permitted by law, GlobalPartsHub shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Malaysia, without regard to its conflict of law provisions. Any disputes shall be subject to the exclusive jurisdiction of the courts of Kuala Lumpur, Malaysia.
